§ 1 Scope and Provider

These General Terms and Conditions (GTC) apply to all orders placed by consumers and business customers through the online store at sloy.studio.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code). A business customer is a natural or legal person acting in the course of their trade, business or profession when concluding the contract (Section 14 German Civil Code).

We do not recognise any deviating terms of the customer unless we have expressly agreed to their validity in writing.

§ 2 Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer but a non-binding invitation to order.

By clicking the order button, you submit a binding offer to purchase the goods contained in your shopping cart. Immediately after submitting your order, you will receive an order confirmation by email, which does not yet constitute acceptance of your offer.

The purchase contract is concluded once we expressly declare acceptance of the order or dispatch the goods. If we do not accept your order, we will inform you without delay and refund any payments already made.

Before submitting your order, you can change your entries at any time using the correction functions of your browser and the order form, or cancel the order.

§ 3 Storage of Contract Text and Contract Language

We store the contract text and send you the order details together with these GTC by email. The contract languages are German and English. The German version prevails.

§ 4 Prices and Shipping Costs

All prices stated are final prices in euros and include statutory VAT.

Shipping costs may apply in addition to the stated product price. The amount of shipping costs and the delivery countries are set out in our shipping policy. Applicable shipping costs are clearly communicated to you during the order process before you submit your order.

§ 5 Payment Terms

The payment methods displayed during the order process are available, including credit card, PayPal, Klarna, Apple Pay, Google Pay and Shop Pay.

The purchase price is due for payment upon conclusion of the contract. Processing takes place via the selected payment service provider, whose terms apply in addition.

§ 6 Delivery and Retention of Title

Delivery is made to the delivery address you provide. Information on delivery times and delivery countries can be found in our shipping policy and on the respective product page.

If an ordered product is unavailable, we will inform you without delay and refund any payments already made.

The goods remain our property until payment has been made in full.

For consumers, the risk of accidental loss and accidental deterioration passes only upon handover of the goods to you. For business customers, the risk passes upon handover to the carrier.

§ 7 Right of Withdrawal

Consumers have a statutory right of withdrawal. Details and the model withdrawal form can be found in our withdrawal policy.

You may also declare your withdrawal using the "Cancel contract" button on our website.

§ 8 Warranty

Statutory liability for defects applies. The limitation period for claims for defects in new goods is two years from receipt of the goods.

If the delivered goods are defective, you are entitled to subsequent performance and, under the statutory conditions, to a price reduction, withdrawal from the contract or damages.

For business customers, a limitation period of one year from handover of the goods applies; the obligation to examine and give notice of defects under Section 377 German Commercial Code remains unaffected.

Please inspect the goods upon receipt and report any visible transport damage promptly. This is not required to preserve your statutory rights, but helps us pursue the matter with the carrier.

§ 9 Product Information

Our products are manufactured using 3D printing from PLA. Due to the production process, slight variations in colour, surface texture and dimensions may occur. The display of colours on screens may also differ from the actual product depending on device and settings. Such variations do not constitute a defect insofar as they are customary and reasonable.

Information on mounting, load capacity and care can be found on the respective product page and in the enclosed instructions. Please observe these, as improper mounting may cause damage.

§ 10 Liability

We are liable without limitation for damages arising from injury to life, body or health resulting from an intentional or negligent breach of duty by us or our vicarious agents, as well as for damages based on intent or gross negligence.

In the event of a slightly negligent breach of essential contractual obligations — obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance you may regularly rely — our liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

Otherwise our liability is excluded. Liability under the German Product Liability Act and within the scope of any guarantees given remains unaffected.

§ 11 Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contractual relationship is Hamburg.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
